    PRIVACY POLICY

    Data Privacy is of high importance for Macti, that guarantees the transparency and legitimate treatment of users’ personal data on the website www.mactiofficial.com (the “Website”). This Privacy Policy sets out how users’ personal data are processed, stored and protected.

    PERSONAL DATA CONTROLLER

    Macti, owned by Martina Candotti, based in Padova, Via Carlo Leoni 19, is the controller of the personal data submitted by the user on the Website. 

    Types of DATA

    Through the Site, Macti receives and collects data that the users actively submit as well as data that Macti passively tracks:

    Actively Submitted Data: When users purchase products through Macti Website or subscribe to the newsletter, they are providing, and Macti is therefore collecting, data such as name, email address, delivery address, telephone number, etc., as well as credit card information. In each such instances, users will acknowledge the type of data Macti collects through the website, because they actively submit it. Subject to users’ prior consent, Macti collects actively submitted data primarily for the purpose for which the data are sent (i.e. purchase and delivery). Macti may also use this data internally for advertising purposes, for promoting new products, and informing users about products, services, initiatives, and events. Users are always free to opt out of receiving marketing emails and to unsubscribe from the newsletter.

    Passively Collected Data: When users visit the Website, Macti may passively collect information on users’ device and Internet connection, such as the date and time of users’ access to the Website, the Internet address of websites from which users link to the Website, users’ movements and preferences on the Website.

    Macti uses the same technology employed by many other websites, including, without limitation, cookies and similar tracking technologies, to collect information such as the aforementioned. Macti passively collects this data primarily for purposes of administering, protecting and improving the Website, to better understand the preferences of its visitors, to identify server problems, to compile aggregated statistics about Website usage and to help visitors personalizing their experience on the Website.

    Macti may also combine passively collected data with data that are actively submitted by the users to provide them with a better service, to customize the Website, to compile and analyze statistics and trends, to otherwise administer and improve the Website and to personalize offers.

    Please be advised that Macti do not target its services to children under the age of 16.

     

    PROVISION OF PERSONAL DATA

    The provision of users personal data is optional. However, if users want to receive information on Macti products and be inserted in the customer database, they need to fill in all mandatory fields in the form collecting their personal data or subscribe to the newsletter.

    The processing of users personal data for the purposes indicated in the “Purpose of data processing” section, below, is subject to users prior express consent.

    If users withhold or deny their consent, Macti may not be able to offer them a personalized service. They will not be informed of any initiative that may interest them and/or they will not receive any other commercial information on products, initiatives and events sponsored by Macti.

    Users may withdraw their consent to the processing of their personal data at any time, by sending an e-mail to info@mactiofficial.com, or by using the “unsubscribe” link included in any Macti commercial electronic communications.

    PeRSONAL DATA TREATMENT AND STORAGE

    Users’ personal data are processed in compliance with the necessary security requirements.  

    Users’ data are kept for the time needed to achieve the purposes they have been collected for:

    • Data collected during the purchase process: are kept for 10 years from the date of the invoice;
    • Payment data: are kept until the expiration of the “right of withdrawal” period;
    • Data collected for commercial purposes: are kept until the user requests to delete his/her account or until the service is provided.

    When the user provides consent, his/her data is collected and processed for marketing and profiling purposes for a period of 10 years. After this time, the data will be automatically deleted.

    Due to technical reasons, the termination of the data processing will take place within 60 days from the user’s request.

    The data is stored within the European Economic Area (“EEA”) but it may also be transferred to and processes in a country outside the EEA. Any transfer of users’ personal data will be carried out in compliance with the applicable law.

     

    DATA ACCESSIBILITY

    Macti grants access to users information to service providers and third parties that process or maintain data on its behalf, including, without limitation, website hosting service providers, payment processors, freight forwarders, carriers, and such individuals or companies that conduct, manage or otherwise handle Macti marketing and promotional campaigns. Third parties are subject to strict confidentiality obligations and may treat users data only in accordance with Macti instructions.

    The user acknowledges that Macti may also share his/her information to respond to law enforcement requests, court orders or other legal process, or as otherwise required by any applicable law or regulation.

     

    USER’S RIGHTS

    Right to access: The user has the right to request information about the personal data Macti holds on him/her at any time (art. 15 UE Regulation 2016/679).

    Right to portability:  when/if Macti treats personal data, based on the user’s consent, the user has the right to get a copy of the data transferred to him/her or to a third party (art. 20 UE Regulation 2016/679).

    Right to rectification: The user has the right to request rectification of his/her personal data in case the information is incorrect. This also implies the right to have incomplete personal data completed (art. 16 UE Regulation 2016/679).

    Right to erasure:  (art. 17 UE Regulation 2016/679) The user has the right to erase any personal data treated by Macti at any time except for the following circumstances:

    -the user has an ongoing matter with the Customer Service;

    -the user has an open order that has not been shipped or partially shipped;

    -the user has an unsettled debt with Macti;

    -if the user has made any purchase, his/her data will be kept for book-keeping purposes.

    Right to object to direct marketing: The user has the right to object to direct marketing, including profiling analysis made for direct marketing purposes (art. 21 UE Regulation 2016/679).

    Right to restriction: (art. 18 UE Regulation 2016/679) The user has the right to request that Macti restricts the processing of his/her personal data under the following circumstances:

    -if the user objects to a processing based on Macti legitimate interest, it shall restrict all processing of such data pending the verification of the legitimate interest.
    -if the user claims that his/her personal data is incorrect, Macti must restrict all processing of such data pending the verification of the accuracy of the personal data.

    -if the processing is unlawful, the user can request the restriction of the use of his/her data or its erasure.

    PURPOSE OF DATA PROCESSING

    Users’ personal data are processed in order to create an account and provide the services requested through the website. Users are free not to provide Macti with their data, but they will not be able to make the purchase.

    Given the users’ consent, Macti will use their personal data for further purposes, such as marketing, commercial or advertising communications, direct sales, market research, in-store sales support worldwide through email (newsletter), telephone, SMS, MMS, chat, instant messaging, social networking and traditional mail. Moreover Macti may collect information about users’ preferences, habits, lifestyle and purchases made in order to create group and/or individual profiles (“profiling”) and to send the user personalised messages. Personalised messages may be sent by email (newsletter), phone, SMS, MMS, chat, instant messaging, social networking and traditional mail. The user may at any time select his/her preferred means of communication or refuse to receive promotional communication by any or all of these means of communication. Consent for the above marketing and profiling purposes is optional.
